New Regulations for Foreign Institutions intending to participate in the rehabilitation and reconstruction of Aceh and the Island of Nias (North Sumatra)
The Tsunami tragedy has produced the seeds of unprecedented global solidarity. Never before did a natural disaster bring out so much compassion, goodwill and generosity. And with the establishment of the Rehabilitaion and Reconstruction Agency (known as BRR – Badan Rehabilitasi dan Rekonstruksi), the rebuilding of Aceh and the Island of Nias (Province of North Sumatera) is being carried out with dignity, transparency and strong community involvement.
In order to pursue effective and efficient undertaking of the rehabilitation and reconstruction funded by grants and foreign donations that involve the participation of numerous foreign institutions and individuals, the BRR through the Rule of the Chairman of BRR Executive Board No. 61 of 2005 (effective since November 28, 2005) has established a Joint Committee to coordinate the various forms of activities being carried out by foreign institutions and individuals.
The main tasks of the Joint Committee are :
- To give recommendation to the BRR Executive Board on the program proposed by foreign institutions and individuals working through international grants and donations.
- To register all applicants intending to participate in various rehabilitation and reconstruction projects .
- To assist the BRR Executive Board by providing services and facilities on consular matters, immigration, manpower, tax, customs & excise related to foreign institutions and individuals.
Further more, in recognition of the need to obtain a clear and comprehensive understanding of the work progress in the rehabilitation and reconstruction of Aceh and Nias, the BRR Executive Board has issued Regulation of the Chairman of BRR Executive Board No. 02 of 2005 (effective since September 30, 2005) concerning the mandatory registration for all foreign institutions and individuals that are taking part in the rehabilitation and reconstruction in Aceh and Nias. The summary of the Regulation are as follows:
- Any foreign institutions intending to undertake rehabilitation and or reconstruction activities in Aceh and Nias must register with the BRR Executive Board, submit a description of its planned activities and obtain certification prior to executing the intended works or projects in the affected areas.
- Foreign institutions that have already been registered under the stipulations of the relevant Indonesian laws prior to the issuance of this Regulation are not required to register and obtain a certification, and are permitted to carry out their activities.
- Foreign organizations that have commenced to execute their rehabilitation and/or reconstruction projects prior to the issuance of this Regulation and have not registered must obtain a certification within 30 days after the issuance of this Regulation.
- Foreign organizations are strictly prohibited from conducting any activities that give a reasonable impression of an intention to disturb the existing religious and political harmony, peace and security of the local community, law and order in the affected areas, and any other matters related to local custom and culture.
- All foreign organizations are required to demonstrate a social and cultural sensitivity towards issues related to the Tsunami and earthquake, as well as issues on the peace process in the Province of Aceh. Therefore, foreign organizations must not carry out any activities that could disturb and/or affect the condition and/or the peace process that is currently being implemented in the affected area.
- All foreign organizations are required to comply with all other rules and regulations that are not stipulated under this Regulation, but have been or will be issued by the BRR Executive Board in the framework of the rehabilitation and reconstruction of the affected areas.
- The Executive Agency will issue a Registration Certificate only after all requirements have been met by the applicants. This Certificate will serve as a permit to commence intended works or projects in the affected areas.
- To apply for the Registration Certificate, copy of the following documents must be submitted :
- Notarized Articles of Association of the organization in accordance with the laws of the country of origin.
- A notarized legal document that indicates the organization is registered under the laws of the country of origin.
- A notarized legal document assigning individual(s) to the undertaking which includes names of authorizing executive(s) responsible for this assignment.
- Valid passport(s) of this individual(s)
- Work/Program Proposal
- Financial documents from a bank on the availability of the funds required for the undertaking of the said proposal.
- A referrence document or publication on the reputation and credibility of the institution/organization
Any failure to comply with this Regulation and/or future implementation regulations and amendments will result in administrative and legal sanctions, including cancellation of the organization's working permit.
